Just when we thought it couldn't get worse...  
Today we received the letter we feared we might get from our landlords:

"This letter informs you that you are in violation of your rental agreement. There are people receiving mail and inhabiting (#) on a continuing basis as witnessed by our daughter and I. I am giving you the opportunity to restore (#) to the contract terms. If you chose not to do so I will be forced to start eviction proceedings against you."

My response:

Dear [landlords' names],

We are in receipt of your letter dated October 6, 2006. We carefully read through our rental agreement and do not find anything about relatives temporarily staying with us or limits on such stays, only about "subletting" and "assignment." So we do not believe we are in violation of our rental agreement since we are not subletting and the visit is temporary.

My daughter (legal name) and her two sons (Jonathan and Valente) were forced to leave their home in mid-August to escape domestic violence. She naturally turned to me (Tapati) for help during this crisis. She had established a separate bank account back in May in anticipation of the need to move as violence escalated in her marriage. She used our address so as not to alert her husband that she was beginning to put aside money to leave him--not wanting to spark another violent incident.

She called the women's shelter to see if she and her children could go there. They were filled to capacity and advised that if she was presently staying somewhere safe they could not offer shelter. Other women needed it more and they usually have a waiting list. (It is terrible that there is so much violence in our society that this is the case most everywhere.)

She has applied for public aid in the interest of acquiring funds to get her own place as soon as possible. She has another appointment with them on October 24th and we hope she will start receiving aid and food stamps soon. They will aid her in also finding employment and she's getting on the waiting list for housing assistance. As soon as she has sufficient funds to get into a place she will leave. It's never been our intent for this to be an ongoing or long term arrangement as this apartment is too small for that. If we had the funds to help her pay last month and deposit, we would do so.

We naturally hope to avoid losing our own home in our efforts to help our daughter get on her feet. We can and will try to see if the shelter will now take her. We can't guarantee that they will have room for her but we will see and let you know what they say.

If you decide that we must leave, please just let us know and we will immediately look for another place rather than have a formal eviction on our record. We believe that we have been good tenants and hope for a good reference. We're also willing to pay for any increased water use in August, September and October.

Ironic that this is happening during Domestic Violence Awareness Month.

I hate landlords :( I hope they don't continue to give you a hard time about this...

I've certainly had more than my share of landlord problems but I guess that comes from being a renter from the age of 17...30 years now.

I do hope they decide not to be jerks and make us move. But I'm trying to psych myself up in case they do. At least if we move we can find a place with better insulation and I won't have to freeze all winter. I like many things about this apartment but there are some things I could do without.

Let me do some research--I'm almost sure there's some legal basis to prevent them from evicting you under the circumstances!

If there isn't, there ought to be. With shelters always filled to capacity and relatives and friends being the natural fall-back option, no one should be forced to choose between offering safe shelter and keeping a roof over their own head.
